Global Terms And Conditions Of ZORN Motorsport GmbH

§1 Scope Of Application

(1) The following General Terms and Conditions in the valid version -at the time of conclusion of the contract- shall apply exclusively to the sale of goods between us and a consumer.

(2) A consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession; whilst a trade customer means a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his/her or its trade, business or profession and not as a consumer.

(3) We decline validity of any customer’s General Terms and Conditions, even if the customer refers to its own General Terms and Conditions

§2 Conclusion Of A Contract

(1) The following regulations about entering a contract are valid for orders via our online shop www.zorn-motorsport.de.

(3) The product illustrations and offers in our online shop are for informational purposes only and do not constitute a legally binding purchase offer. The legally binding purchase offer is made by the customer by ordering the goods via the online shop.

The contract regarding the purchase of the goods ordered by the customer is only concluded if we provide a purchase order confirmation to the customer via email within 5 working days from receipt of the order of the customer, or if we dispatch/deliver the ordered goods within 5 working days from receipt of the order of the customer.

(4) Ordering goods via our online shop follow the rule: a customer submits a binding offer in the form of an order to purchase the goods collected by him in the shopping basket and successfully completes the checkout process.

Checkout process in detail:

1) selecting the good/s and adding it/them to the shopping basket
2) verification by clicking the „checkout“ button
3) entering his personal data
4) selection of the shipping details
5) selection of the payment methods
6) verification of all data
7) placing a binding order by clicking the „checkout“ button

The customer may at all times until placing his binding order by step 7) view his customer data or order data and change them if necessary. Amendments respectively corrections of potential input errors may be carried out by the customer by pressing the button “Back” within the ordering process in the online shop. The order process can be cancelled by closing the browser or browser tab. After the order of the customer has been sent and after receipt of such order by us, the customer will receive an automatic acknowledgment of the receipt of the order via email. This reply will be sent to the email-address provided by the customer. However, the order acknowledgement shall not constitute an acceptance of the customer’s offer for entering into a contract. No contract shall be formed until we send a purchase order confirmation to the customer or dispatch/deliver the ordered goods.

(5) Storage of contract text of orders via our online shop: we store the contract text and data and send you order details, terms and conditions in the valid version -at the time of conclusion of the contract- as well as withdrawal statement via email. At any time, a customer may view these General Terms and Conditions as well as the instruction on the right of withdrawal including the standard form of a declaration of withdrawal under https://zorn-motorsport.myshopify.com/policies/terms-of-service. If you created a customer account in our online shop, you are able to view recent orders in this account.

§3 Pricing, Shipping Costs, Payment, Due-Date

(1) All prices are stated in Euro, value-added tax (VAT) included. Shipping costs are not included, they will be calculated during checkout process and will vary depending on shipping destination, dimension and weight.

(2) Available payment methods are pre-payment (bank transfer), PayPal, credit card and shopify payments. We reserve the right to exclude methods of payment and/or to perform a solvency check in individual cases.

(3) Payment is due upon the date of order acknowledgment. In case of pre-payment (bank transfer) as chosen payment method, customer is obliged to complete payment immediately.

§4 Shipping

(1) Unless stated otherwise in the product details, all parts are ready to ship immediately. The estimated timeframe for delivery shall be 2 to 5 working days for deliveries within Germany, 4 to 10 working days for deliveries elsewhere in Europe and 6 to 8 weeks for deliveries outside of Europe. Delivery period begins with the date of full payment of the contract price, respectively one day after issuing the bank transfer for payment method pre-payment. If the last day of the delivery period is a Saturday, Sunday or bank holiday, the due-date will become the following working day.

(2) Shipping is carried out through our shipping partner(s). In the event that the customer is a consumer as defined above, the shipping risk shall be borne by us.

§5 Reservation Of Title

The goods remain our property until full payment has been received.

§6 Right Of Withdrawal

6.1 Right of withdrawal for consumers within the EU

If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which you or your representative, who is not the carrier, have/has taken possession of the goods.

of your decision to withdraw from this contract by a clear statement (i.e., a letter sent by post or email). You can use the attached standard form of a declaration of withdrawal; however, this is not mandatory.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You have to return the goods promptly and not later than within fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You are responsible to bear the costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the composition characteristics and functioning of the goods.

6.2 Right of withdrawal for consumers outside the EU

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the composition characteristics and functioning of the goods.

If you paid customs fees and duties in the country of destination, then in the case of a return the destinations customs will not refund these fees, unless the destinations customers and boarder control agree otherwise.

You are responsible to bear the full costs of returning the goods including shipping and custom duties. Please inform yourself about how to declare the goods in order to avoid any extra costs before shipping your return. Costs arising for ZORN Motorsport GmbH will be deducted from the refund.

§8 Claims For Defects And Liability

Claims under liability for material defects of purchased goods are governed by the statutory laws, in particular sections 434 et seq. of the German Civil Code.

§9 Contract Language

These terms and conditions are written in German and English. Even with the intention of forming equal counterparts, only the German text will prevail in the event of a dispute.
